Pathfinder Pedal operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”).

Prices are subject to change without notice. The price charged will be the price in effect at the time the order is placed. We are not liable for shipping and delivery delays. All delivery times are estimates. We are not responsible for delays caused by shipping carriers or events outside our control. Once we transfer products to the carrier, title and risk of loss pass to you.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL CONCENTRIC INDUSTRIES LLC, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, ARISING FROM YOUR USE OF ANY OF THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

You agree to indemnify, defend and hold harmless Pathfinder Pedal, Shopify, and our affiliates from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

If any provision of these Terms is determined to be unlawful or unenforceable, that provision shall be deemed severed, and the remaining provisions shall remain in full force and effect.

These Terms of Service and any policies posted by us constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding all prior agreements.
SECTION 20 - ASSIGNMENT
You may not assign this Agreement. We may assign these Terms and our rights and obligations without consent.
SECTION 21 - DISPUTE RESOLUTION AND GOVERNING LAW
THIS IS A CRITICAL RISK MITIGATION CLAUSE. In the interest of resolving disputes in the most expedient and cost-effective manner, you and Concentric Industries LLC agree that every dispute arising in connection with these Terms of Service will be resolved by BINDING ARBITRATION.
Arbitration is less formal than a lawsuit and uses a neutral arbitrator. The arbitration will be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The laws of the state where Concentric Industries LLC is headquartered will govern these Terms.
